1. Introduction
This Acceptable Use Policy ("AUP") governs your use of the ClearEDI
platform and related services (the "Services"). This AUP is
incorporated into and forms part of our
Terms of Service.
By using the Services, you agree to comply with this AUP. Violation
of this policy may result in suspension or termination of your
access to the Services, and in some cases, legal action.

2. Scope and Application
This AUP applies to:
- All users of the ClearEDI platform

All data processed through our Services, including EDI documents,
API requests, and eCommerce integrations
- All connectivity methods (SFTP, AS2, REST API)

Third-party integrations (Amazon Seller Central, Shopify, etc.)
3. General Prohibited Activities
You may not use the Services to engage in, facilitate, or promote
any of the following activities:
3.1 Illegal Activities

Violating any applicable local, state, national, or international
law or regulation

Facilitating or promoting illegal activities, including fraud,
money laundering, or sale of illegal goods

Infringing on intellectual property rights, including copyrights,
trademarks, patents, or trade secrets

Transmitting or storing material that is defamatory, obscene,
threatening, harassing, or otherwise unlawful
3.2 Security Violations

Unauthorized access to or use of systems, networks, data, or
accounts belonging to ClearEDI or third parties
-
Probing, scanning, or testing the vulnerability of any system or
network without authorization

Breaching or circumventing authentication or security measures
-
Intercepting or monitoring data not intended for you without
authorization
-
Sharing account credentials or allowing unauthorized access to
your account
-
Using automated tools to access the Services in a manner that
exceeds reasonable request volume
3.3 Malicious Code and Attacks

Transmitting viruses, worms, Trojan horses, malware, spyware, or
other harmful code
-
Launching denial-of-service (DoS) or distributed
denial-of-service (DDoS) attacks
-
Engaging in activities that disrupt, degrade, or interfere with
the Services or infrastructure
-
Creating, hosting, or distributing ransomware or other extortion
software
3.4 Spam and Abuse

Sending unsolicited bulk email, messages, or communications
(spam)
-
Phishing, pharming, or engaging in identity theft or deceptive
practices
- Operating pyramid schemes or multi-level marketing scams
-
Harvesting or collecting email addresses or personal information
without consent
3.5 Abuse of Services

Using the Services in a manner that exceeds reasonable usage
limits or degrades performance for other users

Reselling or redistributing the Services without authorization
-
Reverse engineering, decompiling, or attempting to extract source
code from the Services
-
Removing, obscuring, or altering any proprietary notices or labels
-
Using the Services to develop competing products or services
3.6 Data Misuse

Accessing, using, or disclosing data belonging to other users
without authorization
-
Storing or transmitting personally identifiable information (PII)
in violation of applicable privacy laws
-
Failing to implement reasonable security measures to protect
sensitive data
-
Retaining data longer than necessary or as permitted by applicable
laws and policies
4. Amazon SP-API Specific Requirements
If you use our Amazon Seller Central integration, you must comply
with Amazon's Acceptable Use Policy and Data Protection Policy, in
addition to this AUP. The following activities are strictly
prohibited:
4.1 Data Usage Restrictions

No AI/ML Training: Using Amazon data to
develop, train, or improve large language models (LLMs),
multimodal models, or other machine learning systems

No Data Mining: Employing data mining, robots,
scrapers, or similar data extraction tools on Amazon data
-
No Unauthorized Derivatives: Creating
derivative works from Amazon data without explicit authorization
-
No Third-Party Sales: Selling, renting, or
disclosing Amazon data to third parties for marketing or other
unauthorized purposes
4.2 PII Retention and Handling
-
30-Day Limit: Retaining Amazon customer
personally identifiable information (PII) for longer than 30
days after order delivery, except as required by law for tax
compliance

Unauthorized Use: Using Amazon PII for purposes
other than order fulfillment, tax calculation, or legal
compliance
-
Inadequate Protection: Transmitting or storing
Amazon PII without appropriate encryption (TLS 1.2+ in transit,
AES-128+ at rest)
4.3 SP-API Restrictions
-
Exceeding SP-API rate limits or making excessive API calls
-
Misrepresenting your relationship with Amazon or using Amazon
trademarks without authorization
-
Violating Amazon's partner agreements, seller policies, or
marketplace terms
-
Serving partners you know or suspect will violate Amazon
policies
4.4 Security and Compliance
-
Failing to implement required security controls (MFA, firewalls,
encryption, vulnerability scanning)
-
Delaying security incident reporting beyond 24 hours
-
Not maintaining audit trails or preventing audit cooperation as
required by Amazon DPP
-
Failing to conduct required vulnerability scans (monthly minimum)
and penetration tests (annual minimum)
5. Reporting Violations
If you become aware of any violation of this AUP or suspect
unauthorized or abusive use of the Services, please report it
immediately:

Abuse Reports: Include detailed information,
timestamps, and evidence if available
6. Consequences of Violations
Violations of this AUP may result in one or more of the following
actions:

Warning: Issuance of a formal warning and
requirement to cease prohibited activities immediately

Suspension: Temporary suspension of access to
the Services until the violation is remediated
-
Termination: Immediate termination of your
account and access to the Services
-
Data Deletion: Removal of data associated with
prohibited activities
-
Legal Action: Pursuit of civil or criminal
legal remedies, including injunctions and damages
-
Law Enforcement Notification: Reporting
violations to appropriate law enforcement authorities
-
Third-Party Notification: Reporting violations
to affected third parties, including Amazon for SP-API policy
violations
Important: Violations affecting Amazon Seller
Central data may be reported to Amazon in accordance with their
Data Protection Policy and may result in termination of your
Amazon SP-API access by Amazon.
7. Your Responsibilities
As a user of the Services, you are responsible for:

Ensuring that your use of the Services complies with this AUP and
all applicable laws

Maintaining the security of your account credentials and access
controls
-
Monitoring the activity of users accessing the Services under your
account
-
Implementing appropriate security measures to protect data
processed through the Services
-
Responding promptly to security incidents and cooperating with
investigations
-
Notifying ClearEDI immediately if you suspect unauthorized access
or policy violations
8. ClearEDI's Rights and Responsibilities
ClearEDI reserves the right to:

Monitor the Services for compliance with this AUP and to protect
the security and integrity of our systems

Investigate suspected violations and take appropriate action,
including suspending or terminating access
-
Remove or disable content that violates this AUP or applicable
laws
-
Cooperate with law enforcement and regulatory authorities in
investigating violations
-
Modify this AUP from time to time with notice to users (see
Section 10)
ClearEDI is not obligated to monitor user activity but may do so to
protect the Services and comply with legal obligations.
9. Compliance with Third-Party Policies
When using integrations with third-party platforms (such as Amazon
Seller Central, Shopify, or trading partner systems), you must
comply with their respective acceptable use policies, terms of
service, and data protection requirements. ClearEDI is not
responsible for enforcing third-party policies but may terminate
your access if your violations impact our relationship with those
partners.

- Shopify: API Terms of Service, Partner Program Agreement

10. Changes to This Policy
ClearEDI may update this Acceptable Use Policy from time to time.
Material changes will be communicated via email or through the
Services at least 30 days before the effective date. Continued use
of the Services after the effective date constitutes acceptance of
the updated policy.

12. Relationship to Terms of Service
This Acceptable Use Policy is incorporated into and forms part of
our Terms of Service. In the
event of any conflict between this AUP and the Terms of Service, the
Terms of Service shall prevail. Both documents should be read
together as a single agreement governing your use of the Services.
